Statement: Judicial System in Sudan: the Ignored Fact

 Minister of Justice Tells Visiting Brazilian Lawyers' Delegation

Introduction:
It is no secret that ,Western media is staging unprecedented "war" against Sudan. Such hostile policies have taken many forms, the most pronounced of which being the policy of distortion and the big lie of crimes against humanity in Darfur leveled against the Sudan.

 

All these lies have prompted the so-called International Criminal Court to fabricate accusations for making the world believe that the accusations of the Western media are facts- - and are true.
 

However, there is a fact that everyone knows and which Western media intentionally attempt to cover up: Sudan maintains a viable judiciary system.
 

Unfortunately, at the so-called ICC's halls, justice has no place and cheap politics, administrative and moral corruption have the upper hand, and had it not been for such ugly state-of-affair at this court, it would have also known such fact.
 

Indeed, Sudan is one of the first countries amongst Arab and African countries that established the principles of justice and the sovereignty of the rule of law thanks to its judicial system.
 

The Sudanese judges, who have worked in many countries of the world, have demonstrated their abilities to establish the value of justice and equity. Those in the country are doing the same, and both have given their country its reputation and the trust that it is known for them worldwide.
 

These facts and other topics have been the subject of the conversation,that took place between the minister of justice, Mawalana Mohamed Boshara Dosa, and the visiting Brazilian lawyers' delegation during their recent visit to Sudan.
 

The judicial and legal system in Sudan has a long history
 

"The judicial and legal system in Sudan has a long history, and Sudan is known to be the state where the law is applied fairly and its people are all equal before the law", the minister said.
 

The minister told the visiting delegation ,that the legal institutions in Sudan are swell-established, from the lawyers union, through to the Judiciary to all legislative institutions that make the laws and legislations of the country.
 

 The ministry of justice is in charge of all legal matters that concern the country
 

The minister of justice told the delegation, that his ministry is in charge of all legal affairs in the country, as well as of the legal responsibility of the state ,as before the citizens, of preserving their public and private rights and of all legal advices.
 

He added his ministry, in addition to the above in collaboration with the concerned parties, such as the parliament and the council of ministers, also prepares drafts of laws at the local levels, from the constitution and the laws that regulate citizens' affairs in general. The minister said his ministry is committed to international conventions and agreements, that the state endorses that are compatible with national laws, in collaboration with other concerned parties, such as the parliament and council of ministers.
 

The Sudanese people enjoys freedom
 

The minister said the Sudanese people enjoy full freedom and deal with laws positively and that their rights are preserved by the law.
 

 Justice extends to all and the right for litigation available for everyone
 

The justice minister told the visiting Brazilian delegation that justice extends to all in Sudan ,and the right of litigation is open for everyone. As regards criminals, the state is capable through its legal machineries to bring any person to justice once evidence of their conviction is established.
 

We do not need international machineries
 

The minister said justice in Sudan, is available for all and that there is no need for international machineries and that the Sudanese trust their judicial system. He added his ministry conducts its duties of realizing justice independent of the executive body and in accordance with the law.
 

 The Sudanese judiciary is independent
 

The minister of justice re-stressed that Sudanese judiciary enjoys full independence, and that it is independent of the ministry of justice as the case in many parts of the world.
 

He added the judiciary is administratively, technically and financially independent and that, the law regulates citizens' affairs and that all citizens are equal before the law. He said all institutions of the government cooperate with each other. 
 

The minister said his ministry, and in order that it can carry out such duties, has organized itself according to an organizational chart ,that helps it carry out and follow up the implementation of its tasks.
 

As regards the set up of the ministry, the minister listed the major departments at the ministry which include: general affairs for legislation - civil affairs – court cases procedures – public prosecutor in addition to other departments that include commercial registration and intellectual property.
 

The minister called on the visiting delegation, to ignore the misguiding Western media reports.
 

"Allegations by Western media of war against humanity in Darfur, are merely intended to distort the image of Sudan and as regards the ICC its aim are politically -motivated," he said.  
 

On the development of relations between the two countries:
 

The minister of justice conveyed to the visiting delegation,the desire of Sudan to strengthen and develop relations between the two countries in the legal field.
 

He asked the head of the delegation to convey his invitation to his Brazilian counter part to visit Sudan.
 

On his part, the ambassador of the State of Brazil to Sudan,conveyed the desire of his country to promote cooperation with Sudan in the legal field. In addition, the ambassador said his country welcomes Sudanese investors, given the great investment opportunity available in Brazil which is witnessing a great trade boom.
 

"You can have anything from us, save for one secret: that of our football skills", the ambassador said jokingly.
 

At the end of the meeting, the visiting delegation thanked the Sudanese for their hospitality and said they came to Sudan to exchange benefits. He added despite the fact that each country has its Faith, both have the same common goals, namely the achievement of justice.
